Terms of Service

These Terms of Service (“Terms”) govern your use of the Kelfon Foundation website and any related online materials we publish (together, the “Site”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.

Kelfon Foundation is a community-driven non-profit organisation based in Nairobi, Kenya. Contact: kelfonfoundation@gmail.com · +254 113 272 461.

1. Who we are and what this site is for

The Site is an information and contact channel for our work in education, sports, mentorship, leadership, and community empowerment. It is not a banking portal, a school admissions system, or a medical or legal advice service.

Programmes currently run through FEBA Academy and community safe spaces. The Youth Empowerment Center described on the Site is a future capital project. Nothing on the Site should be read as stating that that facility already exists.

2. Eligibility

You may browse the Site regardless of age. If you are under 18, do not submit personal information through the contact form without a parent or guardian. Adults who contact us about a child must have authority to do so.

3. Acceptable use

You agree not to:

  • Use the Site for unlawful, harmful, harassing, or fraudulent purposes
  • Attempt to break, overload, scrape, or reverse-engineer the Site
  • Impersonate Kelfon, our founder, staff, partners, or beneficiaries
  • Upload malware or content that infringes another person’s rights
  • Collect personal data of other users from the Site
  • Use our name, logo, or founder’s image to solicit funds except with our written permission

We may suspend access, ignore abusive messages, or involve the authorities if we reasonably believe these Terms or the law have been broken.

4. Contact form and communications

Messages sent through the Site are routed to kelfonfoundation@gmail.com. Do not treat email as a secure channel for passwords, M-Pesa PINs, card numbers, or highly sensitive child-protection details. We will try to respond in a reasonable time but do not guarantee a reply to every message.

5. Donations, grants, and fundraising

Donation payment details (bank account, M-Pesa Paybill, or similar) will be published on the Get Involved page only when they are confirmed. Until then, any “Donate” control on the Site is inactive by design.

When giving is enabled: donations are voluntary; they are not payment for goods unless we say otherwise; we may apply unrestricted gifts to our charitable purposes; restricted gifts will be used for the stated purpose where reasonably possible; we do not provide tax advice — Kenyan or other tax treatment depends on your circumstances and applicable law; we may decline a gift that we cannot accept ethically or legally.

You must not represent yourself as an official Kelfon fundraiser unless we have appointed you in writing.

6. Programmes, scholarships, and volunteering

Descriptions of programmes are informational. Applying, being waitlisted, or expressing interest does not create a right to a scholarship, placement, job, or board seat. Open roles on the Team page are vacancies, not offers of employment.

Volunteers, mentors, and partners may need to complete safeguarding, reference, or screening steps before working with children. We may end a volunteer relationship at our discretion where safety, integrity, or capacity requires it.

Impact categories on the Site are goals until verified figures are published. We will not invent statistics.

7. Intellectual property

Unless otherwise marked, the Site’s text, layout, logo, and original graphics are owned by or licensed to Kelfon Foundation. You may share pages for non-commercial awareness (for example, sending a link to a donor) if you do not alter the meaning or remove attribution. You may not copy the Site as a template for another organisation, sell our content, or use our logo as your own.

Stock photographs are used under their respective licences as generic, representative images. They are not photographs of our named beneficiaries. The founder photograph of Kelfon Onkundi Isaboke is used with his authority as founder.

8. Accuracy and third-party content

We try to keep the Site accurate. Programme details, open roles, and payment instructions can change. The Site may contain typographical errors. Partner slots are placeholders until logos are confirmed. Social network names listed under Connect do not, by themselves, mean an official account is already live.

Links to other websites are provided for convenience. We are not responsible for their content or practices.

9. Disclaimer of warranties

The Site is provided “as is” and “as available.” To the fullest extent permitted by Kenyan law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

Nothing on the Site is professional legal, medical, financial, or immigration advice.

10. Limitation of liability

To the fullest extent permitted by law, Kelfon Foundation and its founder, officers, volunteers, and partners will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or goodwill, arising from your use of the Site. Our total liability for claims relating to the Site will not exceed five thousand Kenya shillings (KES 5,000) or the amount you donated through an official channel in the three months before the claim, whichever is greater, except where liability cannot be limited (including death or personal injury caused by negligence, or fraud).

11. Indemnity

You agree to indemnify and hold Kelfon harmless from claims, losses, and reasonable legal costs arising from your misuse of the Site, your breach of these Terms, or your infringement of another person’s rights, except to the extent caused by our own negligence or wilful misconduct.

12. Privacy

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

13. Changes

We may update these Terms by posting a new version on this page. The “Last updated” date will change. Continued use of the Site after changes means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya. Courts in Nairobi have exclusive jurisdiction, without prejudice to any mandatory consumer or data-protection rights you may have.

If a provision is held unenforceable, the rest of the Terms remain in effect. These Terms are the entire agreement between you and Kelfon about use of the Site, and they do not create a partnership, employment, or agency relationship.
